1710 Trial of William Penn & William Mead Quaker History Rare Legal Book The title of the book is The Tryal of William Penn and William Mead, documenting one of the most important legal trials in British history. Penn’s commitment to religious tolerance and liberty, shaped by his Quaker faith, led him to defy the established Anglican Church. His opposition to religious conformity and advocacy for civil rights directly brought him into conflict with British authorities. William Penn, a Quaker leader, founded the colony of Pennsylvania in 1682, under a grant from the king, building a government around the idea of freedom of religion. Penn signed the Charter of Privileges, which gave all residents of Pennsylvania certain basic rights which includes the freedom to worship. This charter led to the construction of the Bill of Rights.The Trial of William Penn and William Mead (1670): The trial arose after William Penn and William Mead, both Quakers, were accused of unlawful assembly. On August 14, 1670, Penn preached to a gathering of Quakers in Gracechurch Street, London, a public sermon that was deemed illegal by the government due to the Conventicle Act. The Act was designed to suppress non-Anglican religious meetings, seen as a threat to the established Church of England. In addition, the religious assemblies must be composed of 5 or more people. Penn and Mead were arrested and tried for inciting an unlawful assembly. However, what made this trial stand out was the courage of the jury. Despite being pressured by the judge to deliver a guilty verdict, the jury—led by Edward Bushell—refused to comply. This was a revolutionary moment for the independence of juries in Britain. The Judge did not accept the verdict, including the modified version the jury had agreed on and had them incarcerated with no food, water, and heat. William Penn spoke against this and shouted at the Jury, « You are Englishmen, mind your privilege, give not away your right. » The Juror Edward Bushel replied, « Nor shall we ever do. » After two days of deliberation and despite threats from the court, the jury acquitted both men. Leading the judge to send them to prison once again and not be free until the fine was paid. This sparked an outcry, such as Penn saying this violated the Magna Carta and led to a landmark legal ruling that established the principle that juries could not be punished for delivering a verdict that the authorities disapproved of.
